US and Canada Terms and Conditions

1. This competition is run by Wacoal EMEA Ltd whose registered office is The Corsetry Factory, Rothwell Road, Desborough, Kettering, Northamptonshire, NN14 2PG, company number 00171167 (the “Promoter”).

2. The competition will run from 01/02/19, 00:01 GMT to 08/02/19, 23:59 GMT inclusive. All entries must be submitted by no later the Closing Date. Entries received after the Closing Date will be disqualified.

3. Five winners will each receive three sets of b.tempt'd lingerie (consisting of x3 bras & x3 briefs) - All subject to availability.

4. You can enter the competition by completing all the relevant questions on the online competition form.

5. The odds of winning this competition will depend on the number of entries. This competition has not been conducted previously, however, it is anticipated that there will be many entries.

6. By submitting a competition entry you have agreed to accept and be bound by these Terms and Conditions.

7. To be eligible to enter this competition you must be aged 21 years or over at the time of entering the competition and be:

• a permanent resident of any of the 48 contiguous states of the USA or of Washington, DC; or

• a permanent resident of any Canadian state (other than Quebec)

8. Unfortunately you cannot enter the competition if you have a family member who is employed by or otherwise connected with the Promoter. Proof of eligibility may be required. The Promoter reserves the right to verify the eligibility of all participants and to disqualify any who it determines are not eligible.

9. Only one entry is permitted per person.

10. Any copyright in each entry will be owned by the Promoter and you hereby assign such copyright to the Promoter.

11. The winning entries (each a “Winner”) will be selected by independent judges. Prizes are subject to availability. No cash alternative or substitute to the prize will be offered. The Promoter does not accept any responsibility if a Winner is not able to take up or use the prize. The prize is not transferable.

12. Each Winner will be notified either in writing, by phone and/or by e-mail within 7 days of the Closing Date.

13. The Promoter will make reasonable efforts to contact each Winner. If a Winner has not returned contact from the Promoter in response to a private or public announcement on the relevant social media channel or has not claimed their prize within 14 days of the Closing Date, then the Winner will have forfeited the prize and an alternative winner may be selected.

14. The Promoter is entitled to publish the name and county of each Winner on its website and social media feeds (such as Facebook, Twitter and Instagram) for the Promoter’s promotional purposes.

15. The Promoter will not be liable for a prize that does not reach the intended recipient for reasons beyond the Promoter's reasonable control.

16. The Promoter will send the name and county of a Winner to anyone who writes within one month after the Closing Date requesting details of the winner and who encloses a self-addressed envelope to the Promoter’s address above.

17. The Promoter's decision is final on all matters and no correspondence will be entered into.

18. The Promoter accepts no responsibility for any damage, loss, injury (other than its liability for personal injury or death as a result of the Promoter’s negligence) or disappointment of any kind suffered by any participant in entering the competition, including as a result of any participant winning or not winning the prize.

Your Personal Data

19. Information provided in each entry will be collected, stored and processed by the Promoter for the purposes of managing, administering and promoting the prize draw. Further details regarding our use of your personal data are available in the Promoter's Privacy Notice.

Modification, suspension of termination of competition

20. Whilst the Promoter intends to run the competition as described in these entry terms, it reserves the right to modify, suspend or terminate the competition at any time without liability to you where its operation is affected by events outside the Promoter’s reasonable control, for example technical failure, malicious activity, fraudulent entries or security concerns, or if the Promoter has reason to believe that any part of the competition (or of these entry terms) may be unlawful or otherwise void, restricted or prohibited in any part of the United States or Canada from which we are accepting entries. We will notify you promptly if we need to do this.

Release and indemnity

21. By entering this competition you agree to release us from any liability to you to the maximum extent permitted by law and to reimburse us on demand for any loss, damage, cost or expense we incur as a result of your failure to comply with these entry terms.

Governing law and jurisdiction

22. By agreeing to these entry terms you agree that (a) any disputes, claims and causes of action arising out of or connected with this promotion or any prizes awarded shall be resolved individually, without resort to any form of class action and exclusively by the appropriate courts located in the State of Massachusetts, (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion but in no event attorneys’ fees; and (c) under no circumstances will you be permitted to obtain awards for, and you hereby waive, all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of you and us in connection with this competition, shall be governed by, and construed in accordance with, the laws of the State of Massachusetts without giving effect to any choice of law or conflict of law rules (whether of the State of Massachusetts or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Massachusetts.
